Lindsay Lohan sued ETrade over Milkaholic Baby Super Bowl commercial

9 March, 2010 A+  A-

Lindsay Lohan is on the war path with ETrade Financial concerning a television commercial first aired during Super Bowl XLIV among other Super Bowl commercials and was later shown during Winter Olympics coverage and other programs.

Lohan is suing E*Trade Financial and the lawsuit first came to light in a New York Post report Tuesday claiming that the lawsuit has been filed in State Supreme Court in Nassau County, south of New York City. Lindsay has claimed damages of $100 million plus injunction to stop the commercial from being aired further.

So what's the fuss about with the ad? The ad show a two babies, boy and girl chatting over a video camera. Baby boy tells the girl he did not call her last night as he was taking care of his portfolio. The girl asks, not convinced, "And that milkaholic Lindsay wasn’t over?” The baby boy answers, “Lindsay?” At that point, a second baby girl appears, in front of the boy, and says, “Milk-a-what?”

In her lawsuit, Lindsay Lohan has contended that the second baby girl was modeled after her because the one-word name “Lindsay” was identified with her.

Two commercials were aired from Grey New York (agency for ETrade) during Super Bowl XLIV and others before and after the game. The ads, including the one over which Lohan is suing E*Trade, are available on Youtube for viewing.

E*Trade spokesman Pam Erickson in an e-mail wrote, "We have not yet seen the complaint, so are unable to comment.”

When asked to comment on the lawsuit, Grey spokesman, Owen Dougherty said, "“We never comment on litigation, however unfounded.”

Another media report claimed that Lindsay Lohan decided to sue E*Trade because of the comments she got on Twitter criticizing the commercial and asking her to take legal action. But Mean Girls star herself has been reported to have been cool about it on Twitter, tweeting,  “hahahaha vitamin D never tasted so good!”

Lets see where this ETrade Lindsay Lohan fiasco goes.
